Getting Help for your Cell Tower Lease

It is not uncommon for land owners to find assistance from professionals regarding their land leases with cellular companies for towers being used on their lands. If you have a tower on your property and you get a monthly rental payment in exchange for use of the land, it may do you well and save you a lot of heartache taler to do your due diligence and even hire a professional to help guide you through negotiations or renegotiations. Never rush into any contracts or agreements without knowing exactly what you are getting into. Knowing what goes on in these types of contracts is the key to making sure you get what you deserve for leasing your land. Knowing what you are entitled to and what you want out of the deal is half the battle! You also have to know what is expected of you too, though, because you are going to have some obligations involved in holding up your end of the bargain. Both sides of the negotiating table have obligations to each other.

When you are considering leasing your property and entering into a contract, it is going to be to your advantage to know everything that is going on, everything that is being discussed and everything that is being considered from day one. There are many benefits, advantages and some disadvantages that go along with these types of contracts especially when they are so long term. Typical agreements can have a duration of about 25 years, which is a long time. Your goal is to maximize your guaranteed revenue while at the same time you minimize your obligations and responsibilities.

There are several things that determine if a particular piece of land is going to be really suitable for a cell phone tower to be erected on. Representatives are going to be looking at the location of course, as well as the topography of the land. They are going to send people to investigate to determine how easy it is going to be to erect a tower there. Your land parcel should be relatively flat, there should be few natural barriers, it should be at least 2,500 square feet in area and needs to be relatively easy for them to access when they need to.

What you are entitled to do is ask the company to secure the site by building a fence around the tower to keep intruders out. It is not unreasonable to ask for them to build a fence around your entire property, either. The fence around the tower is very reasonable, but you may have to convince them to do the fence around your whole property. Depending on how large your property is, they may or may not be willing to do it right off the bat. You should also request that the cell phone company pay some of the utility costs and the taxes that will be affected and go up because of their tower being on the land. You will also want to request that they carry your property on their insurance policy. Make sure that you inform your own insurance company of the fact that there will be a cell phone tower on your land so that they are aware, too.
